for the seconde année consécutive, the campagne de déclaration of the loyers of the locaux professionnels (DECLOYER) is lancée.

since the Finance Act rectificative for 2010, the entreprises locataires de locaux commerciaux or professionnels ont vu their obligations déclaratives alourdies. thus, the entreprises locataires to the 1er janvier are tenues de souscrire, in the même délai que their déclaration de résultats, a déclaration spécifique portant on the montant of the loyers correspondants.

to the plan pratique, this déclaration s’effectue en two étapes:

  • since the 1er janvier 2016, the entreprises peuvent récupérer via EDI-REQUETE the liste and the caractéristiques of the locaux qu’they occupaient à this date.
  • the déclaration proprement dite via the formulaire « DECLOYER » doit être souscrite to the more tard the 3 mai 2016.

if en 2015 (première année of the obligation), l’administration n’avait not fait application de sanctions to the déclarants retardataires, en 2016, to the contraire, the production tardive or the défaut de production of the déclaration of the loyers devraient en principe être sanctionnés by l’article 1729 B of the CGI (amende de 150 euros).
